Terms and conditions

• Information on how to enter and prizes form part of these conditions.  By participating, Applicants agree to be bound by these conditions.  Entries must comply with these conditions to be valid. 

• Entry is open to ADA members only (“Applicant”). 

• To enter, each Applicant must, during the Application Period, fully complete the online application form located at https://ada.org.au/dhw-2025-colgate-offer including submitting a health promotion project that meets the “Principles for selection criteria” set out above. 

• Applications will open Monday May 26th, 2025 and close 12am (midnight) AEST Sunday 15th June 2025 (“Application Period”) for delivery in July. 

• Limit of one entry per dental practice and one entry per Applicant. 

• This competition is a game of skill.  Chance plays no part in determining the successful Applicants.  All entries will be judged individually on their merits based on meeting the “Principles for selection criteria” above. The first 230 valid entries, as determined by the judges, will each receive either a BSBF Teachers Smile Kit (“Smile Kit”) or an Older Children toothbrush Dental Health Week Kit (“DHW Kit”). The judges’ decision is final and binding - no correspondence will be entered into. The judges reserve the right to request verification of any information relevant to awarding of the prize, including the information set out in the application form. 

• Judging will take place on the week of June 16th at Australian Dental Association 14-16 Chandos Street, St Leonards NSW 2065. Entries will be judged by the ADA staff responsible for planning Dental Health Week.  

• The successful Applicants will be notified by email on or by 24th June 2025.     

• Prizes consist of the following: 
   
  There are 200x Smile KitsAavailable, which consist of: 
  - 30 children toothbrushes;  
  - 30 children’s toothpaste (20gr);  
  - 30 x 28 day brushing chart to track progress;  
  30 x Brushing guide & healthy eating information; and  
  - 30 x 5 “Adventure in Molar System” Character Stickers.  
  Each Smile Kit is valued at $89.70. Total RRP is $17,940.  
   
  There are 30 x DHW Kits available which consist of: 
  - 72 Ultra Soft toothbrushes (RRP $5.99 each); and 
  - 72 Total Original 115g toothpastes (RRP $5.00 each) .  
    Each DHW Kit has an RRP $791.28. Total RRP is $41,678.40 
   
  Total prize pool RRP $41,678.40  Prizes are not transferable and are not redeemable for cash. 

• The Promoter assumes no responsibility for any failure to receive an entry or for inaccurate information or for any loss, damage or injury as a result of technical or telecommunications problems, including security breaches. If such problems arise, then the Promoter may, acting reasonably, modify, cancel, terminate or suspend the competition. 

• If any prize becomes unavailable for reasons beyond the Promoter’s control, the Promoter may substitute a prize of equal or greater value.  

• Entries remain the property of the Promoter.  Details from Applicants will be collected and used for the purposes of conducting this competition (which may include disclosure to third parties for the purpose of processing and conducting the competition) and for promotional purposes surrounding this competition.  By entering this competition Applicants consent to the use of their information as described and agree that the Promoter may use this information, or disclose it to other organizations that may use it, in any media for future promotional purposes without any further reference or payment to the Applicant. Applicants may access, change and or update their personal information and obtain a copy of the Promoter’s privacy policy by contacting the Promoter on 02 9906 4412 during office hours.  

• The Promoter is the Australian Dental Association Inc. (ABN 95174118424) of 14-16 Chandos Street, St Leonards NSW 2065. 

ACKNOWLEDGEMENT: I, AGREE TO THE FOLLOWING TERMS AND CONDITIONS:

• To ensure compliance with Colgate's Global Anti-Bribery Policy (accessible via the below link) I confirm my understanding that: (i) the Product packages provided by Colgate will only be distributed to participants in the allocated program or project; (ii) the Product packages may not be resold under any circumstances; and (iii) that any unused Product packages remaining in stock by the recipient at the end of the program, must be destroyed or returned to Colgate at Colgate's direction.

• Colgate takes compliance very seriously.  By accepting these products I acknowledge that I have read Colgate's Third Party Code of Conduct, which is available in 14 languages at https://www.colgatepalmolive.com/en-us/who-we-are/governance/third-party-code-of-conduct, and that, to the extent applicable, I will comply with the same during the duration of these terms and conditions.  I further acknowledge that I have read Colgate's Global Anti-Bribery Policy, which is available at https://www.colgatepalmolive.com/en-us/who-we-are/our-policies/anti-bribery-policy, and that I will comply with same during the duration of these terms and conditions.  Further, I understand that any products are provided to the program solely to facilitate the above mentioned oral health promotion activities and projects; these products are not contingent on mine and/or the program's use or recommendation of Colgate's products.

• If employed: By accepting these Colgate products, I warrant I have done so in accordance with my employer's policies and procedures.

• I confirm that
  1. my acceptance of the products does not violate any applicable law or regulation, nor does it conflict with any duty or obligation that I owe to any other third party, including to my employer and
  2. I have obtained all relevant approvals to act as an intermediary to on supply the products for the program.

• Colgate wishes to set out its limitation of liability in respect of the products. The only conditions, warranties and guarantees which are binding on Colgate in respect of the products supplied by it for the abovementioned program are those imposed and required by law (including the Competition and Consumer Act 2010). I and/or the program must distribute the products in their original packaging with no alteration. Except for any liability that cannot be excluded by Law (in which case that liability is limited to the minimum allowable by Law), the liability of Colgate and its employees, agents and contractors will, at Colgate's option, be limited to and completely discharged by either the repair or replacement or cost of repair or replacement, by Colgate of the products supplied to I and/or the program.

To the extent permitted by Law, Colgate (including its officers, employees and agents) excludes all liability (including negligence) for any indirect or consequential loss or damage.
